1.1. These rental terms govern the rights and obligations between the lessor and the lessee in connection with the use of the rental service.
1.2. The rental terms are determined on the basis of a written agreement, a price offer or a client contract, depending on the nature and conditions of the work.
1.3. All additional terms and special agreements are fixed in the price offer or in an agreement concluded between the parties.
2.1. Lessor — the company providing the rental service, Tallinna Teede AS
2.2. Lessee — a natural or legal person who uses the lessor's rental service on the basis of a rental offer or contract.
2.3. Offer — a price offer together with its confirmation by the lessee.
2.4. Equipment — a tool, device, mechanism or other machinery, together with accessories, rented out by the lessor.
2.5. Site — the address or work area specified by the lessee where the rented equipment is used.
2.6. Rental day — a day during which the rented equipment is in the lessee's use, including weekends and public holidays if the equipment is used on those days.
2.7. Engine hour — a unit of accounting based on the operating hours of the construction machine's engine, regardless of the machine's actual movement or workload.
2.8. The accounting of a rental day generally includes up to 8 engine hours. When the engine-hour limit is exceeded, an additional fee applies according to the price list.
3.1. Orders are placed via the Tallinna Teede AS website, by e-mail (marek.rand@ttas.ee) or through another channel that allows written reproduction.
3.2. The rental agreement is deemed concluded after written confirmation of the rental offer by the lessee.
3.4. The lessor has the right to refuse to fulfil an order if the offer has not been confirmed within its validity period.
3.5. If a confirmed order is cancelled less than 24 h before the start of the rental period, the lessor has the right to apply a cancellation fee of 200 €.
4.1. The rental period begins from the moment the equipment is issued at the lessor's premises or at an agreed location.
4.2. The rental period ends when the equipment is returned to the lessor and the return is confirmed.
4.3. Every day during which the equipment is in the lessee's use is counted as a rental day.
4.4. The equipment must be returned no later than 9.00 on the working day following the rental period, unless the parties have agreed otherwise. A later return is counted as a new rental day.
4.5. The lessee is obliged to immediately notify the lessor of any technical faults, damage or maintenance needs.
4.6. The lessor has the right to terminate the contract unilaterally and immediately if the lessee materially breaches the rental terms, including payment obligations, safety requirements, or uses the equipment improperly.
4.7. The lessor has the right to carry out supervision at the site over the use, maintenance and compliance with the lubrication schedule of the machine.
4.8. If a breach of maintenance or use requirements is detected during supervision, the lessor has the right to terminate the contract unilaterally and immediately and to demand the immediate return of the equipment.
5.1. The rental fee is calculated in accordance with the terms set out in the offer.
5.2. Invoices are issued at the end of the rental period or, in the case of longer-term rental, once a month.
5.3. Invoices must be paid within 7 calendar days of the issue of the invoice, unless the parties have agreed otherwise.
5.4. In the event of delayed payment, the lessor has the right to apply a late-payment interest of 0.2 % of the unpaid amount for each day of delay.
5.5. The lessor has the right to demand an advance payment and/or a security deposit before the start of the rental period.
5.6. The purpose of the security deposit is to cover possible damage, defects, cleaning costs or other costs arising from the lessee's breach of obligations.
5.7. The security deposit must be paid before the machine is prepared or issued.
5.8. The security deposit is returned after the end of the rental period, provided that all obligations have been fulfilled and there is no damage or debt.
5.9. The lessor has the right to deduct from the security deposit all damage, additional costs or unpaid invoices.
5.10. The security deposit is used first to cover damage and then to pay for services and additional services.
6.1. The equipment is handed over with a digital handover act.
6.2. Before putting the equipment into use, the lessee undertakes to familiarise themselves with its technical condition and equipment.
6.3. Before using the equipment, the condition of the machine and accessories must be documented with photographs, including: undercarriage; cabin; fuel gauge; engine hours; visible damage.
6.4. The photographs must be sent to the contact or e-mail address designated by the lessor.
6.5. The same documentation requirement applies when returning the equipment.
6.6. If the lessee does not provide photographs, the lessor's documentation is used as the basis in the event of disputes.
6.7. The purpose of the photographs is to avoid disputes over the condition of the equipment.
7.1. Use of the machine with an operator
7.1.1. The lessor provides the lessee with a technically sound machine together with an operator.
7.1.2. If necessary, the lessor may replace the machine with equivalent equipment.
7.1.3. The operator is responsible for using the machine in accordance with safety and operating requirements.
7.2. Working time accounting and transport
7.2.1. The accounting of the machine's working time begins when the machine leaves the lessor's base and ends when it returns to the base.
7.2.2. The minimum working time of the machine is 8 hours, unless agreed otherwise.
7.2.3. The minimum working time of accessories is 4 hours per working day.
7.2.4. After the minimum working time has been reached, working time is accounted for with an accuracy of 30 minutes.
7.2.5. The costs related to the transport of machines and accessories to the site and back are borne by the lessee.
7.3. Mileage and additional fees
7.3.1. Work carried out on weekends, public holidays and during evening and night hours is subject to a 20% higher hourly rate, unless the parties have agreed otherwise.
7.4. Occupational safety and traffic management
7.4.1. The lessee is responsible for all necessary permits, approvals and official notifications.
7.4.2. The lessee is responsible for installing the necessary traffic signs, barriers and safety equipment at the site.
7.4.3. The lessee must ensure the safety of the machines and operators throughout the rental period.
7.4.4. The lessee may not require the operator to perform work in areas or conditions where work is prohibited or dangerous, including near cable lines, substations or other risk areas.
7.5. Claims in the case of rental with an operator
7.5.1. Claims regarding the quality of the machine's or operator's work must be submitted in writing no later than 24 hours after the incident.
7.5.2. The lessor does not consider later claims.
7.5.3. The lessee may not allow the machine to be overloaded or used in conditions that may cause damage to the equipment.
7.5.4. The lessee is responsible for damage arising from the specifics of the site of which the operator was not informed in advance.
8.1. Lessee's confirmations
8.1.1. The lessee confirms that they: undertake to familiarise themselves with the technical condition and equipment of the property before putting it into use; have the necessary knowledge and skills to use the equipment or ensure the use of a competent operator; comply with all maintenance, use and safety requirements; undertake to use the equipment only with operators who hold the required licence and/or have been instructed in occupational safety and machine use.
8.1.2. If the lessee waives the prior inspection of the equipment, the equipment is deemed to have been accepted in its existing condition.
8.2. Lessee's obligations when using the equipment
8.2.1. The lessee is obliged to use the equipment with due care, for its intended purpose and in accordance with the use and safety instructions.
8.2.2. The equipment may be used only by persons with the appropriate licence and competence.
8.2.3. The lessee may not make modifications, repairs or maintenance to the equipment without the lessor's written consent.
8.2.4. Smoking in the machine cabin is prohibited.
8.4. Maintenance, lubrication and cleaning
8.4.1. The lessee is responsible for the daily maintenance and lubrication of the equipment throughout the rental period.
8.4.2. The lessee must follow the manufacturer's maintenance and lubrication schedule.
8.4.3. The bushings and articulated joints of the boom, stick and bucket joints must be lubricated at the end of each working day.
8.4.4. When using a hydraulic hammer, the chisel must be lubricated at least every working hour or the operation of the automatic lubrication must be checked.
8.4.5. The machine's undercarriage, tracks and belts must be cleaned regularly, especially before the cold season.
8.4.6. The engine's ventilation openings and radiator must be kept clean and the fuel separator emptied when necessary.
8.4.7. If the equipment is returned heavily soiled, the cleaning costs are borne by the lessee.
8.5. Fuel, master switch and technical requirements
8.5.1. The lessee must use only clean and high-quality fuel.
8.5.2. Fuel canisters must be clean and rust-free.
8.5.3. The lessee is responsible for damage caused by damage to or blockages of the fuel system.
8.5.4. The lessee must fill the fuel tank at the end of the working day and avoid letting it drop below half its capacity.
8.5.5. The lessee must switch off the master switch at the end of the working day to prevent the battery from draining and damage to the electrical system.
9.1. The lessee is responsible for the preservation and security of the equipment throughout the rental period.
9.2. Outside working hours, the equipment must be kept in a secure or guarded location.
9.3. Insurance coverage does not apply if the equipment is left unattended.
9.4. The lessee is responsible for damage resulting from a breach of any maintenance and use requirements.
9.5. The lessee confirms that the person using the equipment meets all the requirements set out in these terms.
9.6. If the equipment is used by a person whose details have not been provided to the lessor, this is considered a material breach of contract.
10.1. The lessee is responsible for the preservation and upkeep of the equipment throughout the rental period.
10.2. The lessee is responsible for damage resulting from a failure to comply with any maintenance and use requirements (e.g. joint wear, hydraulic system failures, engine damage). Such faults are deemed to be caused by the lessee's negligence.
10.3. In the event of damage to or destruction of the equipment, the lessee is obliged to compensate for all damage incurred in accordance with the repair or restoration costs.
10.4. The lessee is responsible for damage caused to third parties, buildings, underground utilities or the environment.
10.5. The lessor is not liable for technical faults, downtime, lost revenue or any other direct or indirect damage.
10.6. Insurance coverage does not apply if: the equipment is used improperly; the equipment is used without the required competence; the equipment is passed on or subleased without permission; the damage is caused by intoxication or a breach of safety requirements.
11.1. The rental period ends after the equipment is returned and the return is confirmed by the parties.
11.2. The lessor has the right to terminate the contract unilaterally if the lessee breaches the rental terms or fails to fulfil payment obligations.
11.3. The lessor has the right to demand the immediate return of the equipment in the event of a breach of the rental terms.
12.1. All disputes are resolved first through negotiations.
12.2. If no agreement is reached, disputes are resolved in accordance with the legislation of the Republic of Estonia.
13.1. Tallinna Teede AS has the right to specify or supplement the rental terms in accordance with a specific offer, the properties of the equipment or the working conditions.
13.2. All additional agreements must be fixed in writing.
